  • Key responsibilities of the Office of Human Rights (OHR)
     Protect Rights: Ensure individuals receiving services from DBHDS-licensed, funded, or
    operated providers have their legal, civil, and human rights protected.
     Oversight & Monitoring: Monitor compliance with human rights regulations across
    providers.
     Complaint Resolution: Investigate; Monitor and review provider investigations; and
    facilitate the formal process for appeals regarding rights issues.
     Advocacy & Education: Provide training and technical guidance to providers. Individuals,
    families, LHRC and SHRC on rights and responsibilities.
     Policy Administration: Review and assist in creating and updating policies that safeguard
    individual rights.
    Major Activities Going Well
     AIM Safety Visits & Incident Response to Serious Abuse Allegations
    o Onsite “AIM24” visits within 24 hours of alleged abuse with serious injury, restraint with
    serious injury or alleged sexual abuse
    o Assess safety of all individuals in service setting, Initiate individual’s due process and
    ensure provider has initiated their internal investigation; Monitor compliance after
    serious abuse allegations
    o “AIM30” follow up on all substantiated abuse reports to verify implementation of all
    corrective actions
     DSS/DARS/DBHDS Agreement
    o Formalized in 2019: APS/CPS localities send reports of abuse/neglect involving
    individuals receiving services in a licensed program or DBHDS facility to OHR
    o OHR ensures individuals are protected and prevents under-reporting into CHRIS
    o Average 1,500 reports/year; 31 % of reports should have been entered in CHRIS in
    FY25
    o Providers receive a citation for not reporting plus any identified abuse/neglect
     Due Process: Unique to DBHDS-OHR

    o Supported 16 LHRCs with 80+ volunteers
    o 207 due process reviews for individuals (AR appointment, Consent, Restrictions,
    BTP)
    o 35 LHRC Fact-Finding Reviews, 13 SHRC Appeals

    o Identified intersectionality of human rights across all DBHDS staff and programs
    o Established framework to expand basic Human Rights training to Central Office staff
